brand new lionel 6-38422 legacy u-33c derail problem

Before you do, and just incase you haven't already, check the truck swings freely. I have had engines straight from the factories have their wires tied to tight to allow for swing. I have also seen where the brake rigging hangs up on the backs of the steps.

thanks for your help. turned the unit over and checked swing on each truck. the front one swings full left to right smoothly with no resistance. the back one does not swing freely or smoothly. it catches on the frame and stops as it swings thru. I have to push and lift to get it swinging again only to catch again. it seems like the truck is to close to the frame, like it is  missing a spacer or something. its pretty apparent that there is something not right with the back truck.

I would like to tell you to take it back. It is tuff when it's not right out of the box. I will usually dive inside to see what's going on. The Lionel design is a little different and I believe the trucks are removable with a 90 degree twist. Maybe something is bent? 

I don't work on Lionel very much. Their website has diagrams that could show you of something missing? They answer emails and are very helpful too.

it is right out of the box. maybe 1 minute run time. going to call lionel tomorrow about warranty repair

The coupler cut lever on the pilot is in the raised position and preventing the truck from pivoting. When you flip the loco upside down the coupler cut lever raises exacerbating the issue. 

Apply a tiny dab of super glue to the stanchion and hold the cut lever in the full down position until it dries or hit it with a shot of kicker. Truck will pivot freely.
