NIB, in my book is just that. Unopened, untouched. Rarely do I purchase engines and rarely do I purchase an engine sight unseen (such as from an online dealer). When I do, I always ask that it be opened tested for a specific amount of time, and inspected. If there are any issues, I ask that I be contacted immediately and either given a swap or my money back. That has always worked except with one forum sponsor who never opened it and it turned out to be a dud. Then again, I nearly always buy engines from a local dealer.

Via phone, I have dealt with some dealers who would not check an item, before sending it to me, even when I requested it.  After all, if the item is defective the dealer sends it back to the manufacturer for a replacement, or credit, instead of me having to first receive the item, checking and sending back a defective item.

When I am at a store I ask if I may check the item, before I purchase it.

If I am told by the owner, or an employee, that I cannot check the item, before purchase, I leave.  I do intend to have the item checked by either the owner, employee, or myself, in front of the owner, to save time if a return is required.

A friend of mine bought an item at our close by, local hobby shop and when he got home and inspected it, it had been damaged.

He took the item back and had a big to do with the store owner.

The owner stated that my friend must have damaged the item, when at home!!!

New, means just that, 'NEW', untouched, undamaged, complete and having all of which is required and packaged as supposed to be!!!!!

Oh, yeah!!  Be careful of the wording "BRANDEEE NEW!!!!"

Additionally it had none of the cardboard, foam, and wire wrap protecting the trucks from movement during shipping. Additional there was no Owners manual, ribbon or plastic wrapping. This was obviously a customer return, dealer static display. Is this new in box to your way of thinking?

To me he has a duty to disclose this. I would probably be OK with it if I was told up front.   After many many years of purchasing from this dealer I will no longer use him. They did this once before and I just let it go. This time they have lost a 25 year customer.

Fortunately the engine works fine and appears never to have been run. I will be calling for the manual this week. I simply will not be dealing with this top dealer ever again. Dollars talk and mine will walk. Based on my budget of the last two years thats a lot. Its their loss.  I have never been one to complain about things except for bait and switch type nonsense.  I am glad to have the set and it works well. It has not been run.  Just disenchanted with the lack of forthrightness.

I find it interesting that no dealers have responded. Perhaps they simply have not seen it.

NIB - means, new, in the box, not run, not opened that is for you the buyer. Open and if items are missing return it. You spend good, hard earned money on the hobby. Call them and ask for a RMA plus shipping cost back or have them replace it.

Most reputable dealers / distributors will resolve the problem. Recently had an issue like this so I called the dealer, he apologized, overnighted me a new replacement and paid for the return shipping.

Now, I use them more and more. Treated me right.

Call and let them know you are not happy.

NIB - means NIB

Finding a truly "mint" anything requires much time for grading and "immediate" elimination of better stock being found, by chance, on ones shelves. Hence you have devalued the rest ever so slightly. Paying a dealer a search premium can make them more attentive to fussy desires.

 ...................

We agree to disagree on that point.

I refuse to transfer the risk to myself in terms of trying to get resolution from the manufacturer at the point of sale.  I open the item I am buying for inspection and a brief test if it's an engine, and if it's got a significant issue, I will ask if they have any other not spoken for items to see if there is a better one.  If no replacement is available (BTO, you know!), or I ordered the only one, then the item is simply refused for delivery.

If the overall initial quality was better and there were fewer issues (many silly/stupid manufacturing goofs), it would not come to this.

His item was shipped!

I'm talking about shipped sealed packages, your talking about open ones at the LHS, I don't see or understand about any disagreement yet, just different subject.

I'm not talking about decisions of acceptance or returns, or who fixes what.

Only who the final "blame" may, or may not, belong with, on a package that arrives at your door, sealed. If that box is handled by twenty people, in four companies, and is now broke, who is to blame. Is the cat in the box? Only at the mfg.

If I inspect before purchase I'm at a store. At a store I'm going to likely wish to inspect something also. I would have to have a lot of confidence in the company, or want for a product, before I would buy it "sealed". Especially at 2g's.

Thats what I always believed.

That's actually short, sweet, and couldn't be much more on target.

My eye is drawn with approval every time I've scrolled past it.

Personally I still think he might have "oops-ed" on dismissing a company too easily, but he knows his story far better than I.

If you have any doubts about it,
NIB means "No, I balk."

People forget about consumer protection.
On the bay, "Not as Described" is the iron clad agreement that no seller can dispute. Guaranteed money back and shipping. No hassles.
same with Amazon. A few years back, a dealer tried to substitute aftermarket accesories for an overpriced Wii that we bought as a holiday gift for the kids. All we wanted was a refund for fair market value. Amazon stepped in and let us keep it and refunded money. Put the seller on alert.
Anytime I buy a big ticket item, I use my Amex card. Sure I pay a yearly fee, but last year, I got a free commercial grade pressure washer for free. Worth four times what I pay.  No interest and I use it just about anywhere. If you file a claim, they refund your money till the investigate. Ma gain, the responsibility is on the seller to prove their case.
And I am ethical. I never abuse it to get stuff free.
