If it’s CP, yes.

Supposedly the KCS board is going to begin negotiations with CN now and CN, I’m told, has indicated their thought that a KCS/CN merger should be reviewed using the newer review process.

Regardless which pairing ends up before the STB, both will have to make concessions whether the review takes place under old or new guidelines.
