Can't program my brand new Lionel Legacy AC-9 684248

I finally have a place to run my trains, so I took my brand new AC-9 which has only been on display and never on the rails or run.  I got this locomotive from Mr. Muffins back in October of 2017.  It was a BTO and sat in the box for about a year and  then I put up some display shelves and that is where it sat until I repacked it  for our move, it has been in the box  until this last weekend.  The instruction book said that it comes set up for engine #1 for the Legacy controller.  We tried it out using the number 1 for the engine and it ran back and forth very well, sound was good (except for the whistle but that's another story for later).  So we shut it down and turned it over to access the run/program switch and I switched it from run to program, the switches were never moved.  We put it back on the track and I followed the instructions and tried to enter a new engine number and it never did anything, the whistle never blew, it just sat there like it was sleeping although the marker lights were on along with the headlight and number boards.  We tried this several times and could not get it to accept an new engine number.  We took it off the rails and reset the program switch to the run position and put it back on the track.  Powered it up and tried to see if it would accept a new engine number but it would not.  It will only run when you put in the #1 on the controller and then it does everything it is asked to do.  We tried this process several times to no avail, we also noticed that when the smoke switch was in the off position, the engine still smoked and once you turned it off by using the controller it would shut the smoke off.

Does anyone have any ideas or suggestions, I really have no desire to take the engine apart to see if maybe there is a wire loose or whatever might be a problem.  I would call Lionel but it has past the warranty time period and they would just tell me "were so sorry but your warranty has expired,"  you can send it in and we'll look at it, just send a blank check to cover the bill.  If I've done something wrong hopefully someone can set me straight.  I can also just leave it as #1 and run it that way too.
