No, not any longer unless the SRI wants to pay royalties to the movie company (Disney?). In fact, you will not find a single railroad in the US or Canada, short line or otherwise, that uses the "Polar Express" name, as a result of the hefty licensing fee. 

 

I know that was part of the deal for the movie, when the production used 1225 for the basis of the movie digital berk.

 

Yes, but the "free grace period" is long expired.

 

If so, I wonder why they didn't use temporary Polar Express lettering for these trips.

Great shots, I haven't seen a Van Sweringen berk running in many years...
