Well, it's more than just getting the money, it's also perhaps sending a message to the folks that drive around the crossing gates! Even if it wasn't profitable, it might make sense to file the suit to put the motoring public on notice that RR's are not willing to keep taking it in the shorts for gross negligence of the motoring public.
