My answers above are pretyy much where things stand.  The PE 10th Anniversary Berks were sold out rather quickly at the dealer level.  You might find one on the auction sites but you will pay a premium.  The 990 Legacy Systems are readily available.  Can you elaborate on the "second terminal" question.

As long as MTH makes Lionel's Tinplate I doubt this will ever happen as MTH will not put Legacy in a tinplate the produce and it's unlikely that the license of the PE is able to be transferred or sublet to another manufacturer.  It would be cool though.

I wanted the polar express legacy too.. So I just bought an MTH Berkshire and I'm going to make it my Lionel legacy 1225! ;D

i ordered the new lettering for the tender and locomotive. 

Yeah it won't say "this is the polar express," in tom hanks voice but it will sound good going around the tracks with its realistic chuff and it will smoke like it should've in the crappy lionchief set we bought. I was hoping they would've at least come out with a lionchief plus Berkshire.. But turns out I really like how the MTH berk looks and functions.
