Well, I hope everyone in the S gauge world had a great Christmas.  I finally heard back from good ole LBR Enterprises about my AF NYC Hudson hostage situation.  Seems that after I inquired about getting local law enforcement involved to go with me to recover my train, I received a response.  My lost Hudson and cars were located and would be shipped back to me after sending them way back in 2019.  I had paid them over 300 dollars PayPal to convert the engine and cars to LED lighting, new smoker, pull-mor tires, knuckle coupler, repair a broken step, repaint and prototypical numbers and lettering on engine and cars.  Today, December 30th, just after Christmas I received a box from them and I opened it.  Since I had told them to send it completed or not,  even though they told me 2 years ago it was completed, I expected the cars and engine to be in the same condition that I shipped it 3 years ago.  Although they had 3 years to complete the work, I guess I was willing to just have my train back and kiss the 300 plus dollars for conversion goodbye.  It would have been an awesome Christmas miracle to have them all completed since I had paid for that.  Well, I opened the box and my passenger cars appear to be in exactly the same condition.  When I inspected the engine and tender, the connecting wires that had at least given me spark and hum are useless and the pilot truck wheel assembly is completely missing as are both handrails on the sides of the locomotive.  I should be happy to finally receive them in at least the same condition, but worse than when I sent them was quite a shock.  I will be selling/trading the engine, tender, and cars along with my whole collection of S- Gauge equipment and starting over in most likely N-scale for my main layout.  I have lost my interest in AF S-gauge for my main layout.  Sad experience that should not have happened.  Other S-gauge AF fans should avoid this huge pitfall and beware of the wolves in the hobby!  Hey, at least my train returned home for the holidays!

What a shame that you got stuck by someone who is the epidimy of useless. I had been in a situation similar with him but wasn't hung out to dry like you. I hope you reconsider switching gauges, there are good people out there that can help. LED lighting is not a difficult mod, I've done a lot of those myself. Some mods on the locomotives can be handled by folks like Ed Goldin, very reputable, and does excellent work, worth what he charges. Try contacting PayPal about your $300.00, you may get some satisfaction from them. I realize it's three years but what do you have to lose, the worst they can say is no. I hope your new year is better than the last three.

A small-claims action is sometimes emotionally, if not financially, successful.  The claim can be made in the jurisdiction where the fraud occurred, which is your house. The defendant would need to answer the complaint in person or be represented by an attorney. Just the hassle of his having to answer in your local court would be good karma for you.

You don't need an attorney to file the action. And please understand, I AM NOT an attorney, nor do I play one on TV. I am, however, familiar with the workings of small claims actions in New York State. They can be very satisfying.

EDIT:  I would really encourage you not to act rashly and get rid of your S equipment just because of this dirt bag's behavior. There are many S people here who can help you recover from the trauma and can guide you gently back into the hobby. I'm not an S guy myself, but I can appreciate the scale/gauge and enjoy seeing the work that others do.

Having become bimodel (as opposed to bimodal) with S and HO a few years ago, I can definitely say having the diversity, especially the variety, of HO has kept my interest and activity level in the model RR hobby high if not as high as ever.  With that said, I can also say it is my observation that n-scale has and continues to advance with the number of manufacturers, products, quality, features, and capabilities.  Athearn Genesis, Scale Trains, and of course Kato among others keep pushing what can be done and made available.  I'm not adding n-scale to my pursuits (trimodel would be too much), but I enjoy stopping by n-scale (and Z scale) layouts and appreciating how much they evolve - a Kato FEF with DCC and sound runs very smooth and sounds pretty good for its size, or most recently, a Big (within reason) Boy also with sound was pretty incredible.  Even now z with DCC and sound are scooting about on club layouts.  I have to be able to see my trains well enough to work on them.  HO is feasible.  N would push the limits of that for me.  Z, not unless I first became an insect neurosurgeon.  

Best of it all, as always -- there are lots of ways, and no wrong way, to have fun with and enjoy this hobby.
